In these terms the company above is referred to as “the Seller”. For any question about these terms, or to exercise the rights they describe, you can write to the addresses above or use the contact page.
2. Scope and acceptance
These general terms and conditions of sale govern the distance sale, through this website, of the Seller's products — extra virgin olive oil and related specialities — and the booking of tasting experiences at the mill, in accordance with Legislative Decree no. 206/2005 (the Italian Consumer Code) and Legislative Decree no. 70/2003 on electronic commerce. Placing an order implies full acceptance of these terms; the version published at the time of the order applies.
3. Products
Each product page describes the essential characteristics of the goods on sale. Photographs are as faithful as possible but may differ slightly from the product delivered, particularly in colour; oil is an agricultural product, and its characteristics naturally vary with the harvest year. Products are offered while stocks last: if an item turns out to be unavailable after the order, the Seller informs the customer promptly and releases or refunds any amount already committed for it.
4. Prices
All prices are expressed in euro. Unless expressly stated otherwise, they include VAT at the applicable rate. Shipping costs are not included in the product price: for deliveries within Italy they are shown before payment, while for deliveries abroad they are communicated with a dedicated quotation (see section 5). The price applied is the one published at the moment the order is placed.
5. Orders, payment and conclusion of the contract
An order placed through the website constitutes a purchase offer. At checkout the card is not charged immediately: the total amount is only authorised (a hold is placed). The contract is concluded when the Seller confirms the order and captures the authorised amount; a confirmation email is sent to the address provided. If the Seller cannot accept the order — for example because an item is out of stock — the hold is released in full and the customer is informed. The Seller may also decline orders that do not pass the fraud-prevention checks described in the Privacy Policy; in that case nothing is charged and any hold is released, and the customer can contact the Seller to have the decision reviewed by a person.
For deliveries outside Italy the order first goes through a quotation step: the Seller sends a quote that includes shipping costs, and payment only takes place if the customer accepts it. The quote is in no way binding for the customer, who may simply let it lapse.
Payments are processed by Stripe, a PCI DSS–certified payment provider; the main credit and debit cards are accepted. Card details are sent in encrypted form directly to Stripe and never pass through the Seller's servers.
Purchases can be completed as a guest or with a registered account; registration is optional and free of charge. A guest order is managed entirely through the private status link included in the order emails — changes, cancellations or return requests go through that page or the Seller's contacts — and these terms must be accepted again at every new order. A registered customer additionally keeps an order history, saved addresses and a personal profile in the account area, and a recorded acceptance of these terms remains valid for one year, unless a substantially revised version is published in the meantime.
6. Shipping and delivery
Unless a different term is indicated, the goods are delivered by courier to the shipping address given in the order within thirty days of the conclusion of the contract. On dispatch the customer receives a notification, with tracking details where available. For consumers, the risk of loss of or damage to the goods passes to the customer only when the customer — or a third party designated by the customer other than the carrier — takes physical possession of the goods. We recommend checking the parcel on delivery and reporting any visible damage to the courier.
7. Right of withdrawal
A customer acting as a consumer may withdraw from the contract, without giving any reason, within fourteen days of the day on which the customer — or a third party designated by the customer other than the carrier — receives the goods (Articles 52 et seq. of the Consumer Code).
To exercise the right it is enough to send the Seller an unequivocal statement within that period — for example an email to the address in section 1, quoting the order number. The goods must then be returned to the Seller's address in section 1, at the customer's expense, without undue delay and in any event within fourteen days of the notice of withdrawal.
The Seller refunds all payments received for the returned goods, including standard delivery charges, within fourteen days of being informed of the withdrawal, using the same means of payment used for the purchase. The refund may be withheld until the goods have been received back, or until the customer proves that they have been shipped. The customer is liable for any diminished value of the goods resulting from handling other than what is necessary to establish their nature and characteristics.
Under Article 59 of the Consumer Code the right of withdrawal is excluded, among other cases, for: sealed goods which are not suitable for return for hygiene or health-protection reasons and have been unsealed after delivery (for example opened bottles or opened food products); goods which risk deteriorating or expiring rapidly; goods made to measure or clearly personalised.
8. Legal guarantee of conformity
All products sold to consumers are covered by the legal guarantee of conformity provided for by Articles 128 et seq. of the Consumer Code: the Seller is liable for any lack of conformity existing at the time of delivery which becomes apparent within two years. In such cases the customer is entitled, under the conditions set by law, to have the goods repaired or replaced, or to an appropriate price reduction or the termination of the contract. Customers buying in the course of a business are covered by the warranty of Articles 1490 et seq. of the Italian Civil Code, with notice of defects within eight days of discovery and a one-year limitation period.
9. Tasting experiences
Requests to book a tasting at the mill, sent through the contact form, are proposals subject to availability: the booking is only firm once the Seller confirms it. As leisure services with a specific date, confirmed tastings fall outside the statutory right of withdrawal (Article 59(1)(n) of the Consumer Code); if you cannot attend, please tell us as early as possible and we will do our best to move your booking to another date.
10. Liability
Nothing in these terms excludes or limits the Seller's liability where it may not be excluded or limited under the applicable law. Subject to that, the Seller is not liable for delays or non-performance caused by events beyond its reasonable control, nor for damage caused by improper storage or use of the products after delivery. Editorial content and images are provided for information; the information on the product label prevails.
11. Intellectual property
The contents of this website — texts, photographs, videos, graphics, logos and trade marks, including the Cesare Vergari marks — belong to the Seller or its licensors and are protected by law. They may not be reproduced or reused, in whole or in part, without prior written consent.
12. Personal data
Personal data provided while browsing, ordering or booking are processed in accordance with Regulation (EU) 2016/679 (GDPR) and Legislative Decree no. 196/2003. Data are used to perform the contract — orders, deliveries, invoicing, booking management — and, where specific consent has been given, for the purposes covered by that consent. In the Seller's legitimate interest of protecting the platform and its customers, security events (such as registrations, sign-ins and order or payment actions) are also recorded together with technical details of the connection — IP address, browser identifier and language — and analysed for fraud-prevention purposes, together with the fraud-risk assessment provided by the payment provider. Full details, retention periods and your rights — including the right to object — are set out in the Privacy Policy. Data subjects may at any time exercise their rights of access, rectification, erasure, restriction, portability and objection by writing to the addresses in section 1.
13. Complaints and dispute resolution
Complaints can be sent to the contacts in section 1; the Seller replies as quickly as possible, normally within a few working days. Consumers may also resort to the out-of-court alternative dispute resolution (ADR) procedures provided for by Part V, Title II-bis of the Consumer Code, through the ADR bodies established in Italy.
14. Governing law and jurisdiction
These terms and every contract concluded through the website are governed by Italian law. For disputes with customers acting as consumers, the court of the place where the consumer resides or has elected domicile in Italy has mandatory jurisdiction, without prejudice to any more favourable mandatory protections of the country where the consumer habitually resides. For all other disputes the Court of Lecce has exclusive jurisdiction.
15. Changes and final provisions
The Seller may update these terms at any time, for example to reflect changes in the law or in how the shop operates; each order is governed by the version published on the website at the time it is placed. If any provision of these terms is held invalid, the remaining provisions continue to apply. These terms are available in Italian and English; in the event of any divergence, the Italian version prevails.
